Key Highlights

Represented Tata Steel Mining Limited and Tata Steel Long Products Limited, in the petition for approval of their Scheme of Amalgamation with Tata Steel Limited, before the National Company Law Tribunal, Cuttack Bench.

Represented JSW Steel Limited before Hon’ble High Court of Orissa in successfully challenging the award passed by the Micro and Small Enterprise Facilitation Council (MSEFC), Cuttack whereby Hon’ble High Court was pleased to hold that different units of an enterprise although registered individually as Small or Micro have to be clubbed together for ascertaining the total value of the Enterprise which shall determine the classification of the “Enterprise” as a Small or Micro Enterprise for the purpose of maintaining the claim under Section 18 of the MSME Act.

Represented Larsen and Toubro Limited (L&T) before the Orissa High Court in a challenge to Section 10-A(2)(b) of the Mines and Minerals (Development and Regulation) Act, 1957 which was inserted vide the MMDR Amendment Act, 2021.

Successfully represented Edelweiss Assets Reconstruction Company Limited before the National Company Law Tribunal (NCLT), Cuttack Bench, wherein a petition filed by Ghanashyam Mishra and Sons Private Limited for direction to Edelweiss to transfer the pledges was dismissed with a cost of Rs.25,000/-.

Represented Indian Metal and Ferro Alloys Limited (IMFA) in a writ petition wherein Hon’ble High Court of Orissa was pleased to quash the order revoking the Consent to Operate the captive mines by State Pollution Control Board (SPCB).

Represented leading Automobile Dealers of the State of Odisha before Hon’ble High Court in successfully challenging the notification dated 29.03.2016 of the State Transport Authority, Odisha as being ultra-virus to the Odisha Motor Vehicle Taxation Act.

Represented Pradeep Kumar Praharaj in a Criminal Appeal wherein the Hon’ble High Court of Orissa was pleased to reverse the order of conviction passed by the learned trial Court under Section 13 of the Prevention of Corruption Act and acquitted the client by holding that mare recovery of money during trap is not enough to convict in absence of any evidence of demand and acceptance of the amount.

Represented CREDAI, Bhubaneswar, one of the most reputed Association of Builders in the state, in a highly publicised PIL which resulted in the State Government, promulgating The Odisha Apartment (Ownership and Management) Act, 2023.

Successfully defended SS Mining Infra Private Limited in the petitions filed against them under Sections 7 and 9 of the IBC, before the National Company Law Tribunal, Cuttack Bench.

Represented Jagannath Sponge Private Limited against Tata Power Western Odisha Distribution Limited (TPWODL) wherein the Hon’ble NCLT, Cuttack Bench was pleased to declare that the demand of arrears earlier to the Corporate Insolvency Resolution Process (CIRP) issued by TPWODL to the successfully Resolution Applicant was invalid and directed TPWODL to consider the service of electricity connection application of the Appellant.

Represented Dr. Surendranath Behera before the Central Administrative Tribunal (CAT), Cuttack Bench, where the order imposing punishment passed by the department was quashed and Railways was directed to release pension and pensionary dues.

Represented retired Professors of Berhampur University in a writ petition where Hon’ble High Court directed the University and the Department of Higher Education to consider their case of switching from CPF to GPF.
